Privacy policy

This policy describes which personal data we process when you use the Agent Makler website, for what purpose, on what legal basis, and what rights you have. The German version is the authoritative one.

What this website does

Agent Makler is an AI assistant for real estate agents. This website presents the product. You can tell us which offer interests you, request a call, or submit a property for publication on our portal athaus.ai. There are no accounts, sign-ins or payments on this website.

Data we process

Enquiry via the “Talk to us” form

Name, email address and, if you provide it, phone number. Plus your choices: which offers interest you, when you want to start, whether you want a short call, and optionally your role, the number of your listings and the portals you use.

Submitting a property

Name, email address, optional phone number, plus location, property type and, if you provide them, asking price and notes about the property.

Origin of the visit

With each form we store the page language, the address of the referring page (referrer) and campaign parameters from the URL (UTM parameters), so we know which route brought an enquiry to us. Your browser keeps UTM parameters in session storage until the tab is closed; this is not a cookie.

Usage events

We count which offer was clicked, whether the enquiry form was opened and whether it was submitted. These events contain neither name nor email address and no identifier that recognises you across visits; stored are the event type, language, referrer and campaign parameters.

Log data

IP address, timestamp, requested path, browser and device identifiers arise technically on each request and are needed for operation, debugging and abuse prevention. They are held by our hosting provider, not in our database.

Purposes and legal bases

  • Pre-contractual steps (Art. 6(1)(b) GDPR): answering your enquiry, holding the requested call, agreeing a submitted property with you.
  • Legitimate interests (Art. 6(1)(f) GDPR): operational security, abuse and spam prevention, debugging, aggregate analytics, and learning which of our offers attracts interest.
  • Consent (Art. 6(1)(a) GDPR) where we ask for it explicitly. You can withdraw it at any time.

Processors

These providers process data on our behalf under a data processing agreement (Art. 28 GDPR). We use no others.

  • Vercel Inc. (USA): operation of the website including access logs and analytics. Processing in the EU; transfers to the USA under Standard Contractual Clauses.
  • Neon Inc. (USA): the database holding your form entries and the usage events. The database runs in the EU (Frankfurt); transfers to the USA under Standard Contractual Clauses.

Sharing with third parties

We do not pass your details to third parties. If you submit a property, nothing is published by itself: we contact you first. The portal athaus.ai is operated by the same controller; its use is governed by the athaus.ai privacy policy.

Cookies and analytics

Cookies

This website sets no cookies. Language and campaign parameters live in the URL or in your browser's session storage and disappear with the tab.

Analytics

We use Vercel Web Analytics. It works without cookies and without cross-device recognition and yields only aggregate figures (pages viewed, country, device type). No profile about you is created. We do not use Google Analytics.

No automated decision-making

No automated decision with legal effect within the meaning of Art. 22 GDPR takes place on this website. Whether and how we work together is discussed in person.

Retention

  • Form entries: until the purpose no longer applies, at the latest 24 months after the last contact. If a contract is concluded, the retention periods of that contract apply.
  • Usage events: 24 months, thereafter only as aggregate figures.
  • Log data: short-term, for operation and debugging.

Your rights

You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20) and objection to processing based on legitimate interests (Art. 21). Any consent given can be withdrawn at any time.

An email to sourabh@agentmakler.com is enough.

You may lodge a complaint with a supervisory authority. The authority responsible for us is the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59-61, 10555 Berlin, Germany.

Changes to this policy

We update this policy when the website changes. The date above states the current version.
